How is DW not being sued over this?

I came across DW’s new Steve Smith Backstage Practice Pad and I got a strange feeling of Dejá Vu. How the heck are the Knee Pad guys not suing DW over patent infringement?? These are obviously the same products!

The DW pad does look sexier and sports a slicker strap setup, but c’mon, DW. BTW, once you get past the feeling of looking like a complete moron wearing the Nee Pad, it really is a great pad for on the go practice. No stand required!
Their kick practice pad sure looks promising, though!

That’s a good point, but I think he has a pedal endorsement with DW. Notice on his Techniques DVD how he had one of the first titanium 9000 pedals.
